ORDINANCE NO. 2000-882

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WAUCHULA, FLORIDA, AMENDING CHAPTER 19 OF THE WAUCHULA CITY CODES ENTITLED “TRAFFIC” BY CREATING A SECTION 19-21 TO REQUIRE A PERMIT FOR THE PARKING OF TRUCKS, TRACTOR TRAILERS, OR SEMI TRAILERS IN THE PARKING AREA LOCATED AT OAK STREET AND 5TH AVENUE IN THE CITY OF WAUCHULA; ESTABLISHING PERMIT FEES; ESTABLISHING FINES FOR VIOLATIONS; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the City Council of the City of Wauchula has determined there is a need to require a permit for the parking of all trucks, tractor-trailers, or semi- trailers in the parking area located at Oak Street and 5th. Avenue with in the City of Wauchula;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WAUCHULA, as follows;
     All parking of trucks, trailers, or semi trailers, whether connected, disconnected, or separated in the parking area located at Oak Street & 5th Avenue within The City of Wauchula, will be by parking permit only. The cost is $25.00 per vehicle, per year.

     The operator or owner of any vehicle or trailer parked in the area described above without permit shall be in violation of this ordinance and the subject to fine of $100.00, plus the cost of towing and storage of the vehicle or trailer. Each day a vehicle or trailer is parked upon the above-described areas without a current permit shall be deemed a separate violation of this ordinance. The following activities are prohibited, and each prohibited activity shall constitute a separate violation of this ordinance subject to the fine herein:

  1. ANY TYPE OF MECHANICAL REPAIR WORK TO INCLUDE REPAIRING OF TIRES;
  2. REFUELING OF ANY TYPE OF VEHICLE OR TRAILER;
  3. PARKING OUTSIDE OF ASSIGNED AREAS;
  4. LOADING AND UNLOADING OF TRAILERS;
  5. IMPROPER OR NON-REGISTERED VEHICLE;
  6. WASHING OF VEHICLES OR TRAILERS.

2. That any section, paragraph, or portion which may be deemed illegal or unconstitutional shall affect any other section of this ordinance.
3. That all other or parts of ordinances in conflict herewith are hereby repealed.
4. It is the intention of the City Council of The City of Wauchula that the provisions of this ordinance shall become and made part of The Wauchula City Code; and that the sections of this ordinance may be renumbered or re-lettered and the word “ordinance’’ may be change to: section”, or “article’’ or such other phrase in order to accomplish this section.
